ARTICLE 1 – LEGAL NOTICES

ACUITIS is the publisher and operator of the websites www.acuitis.com, www.acuitis.lu, www.acuitisuk.com and www.acuitis.ch (hereinafter referred to as the “Site” or the “Sites”) whose object is the sale or presentation of optical products. This activity is exercised in the strict application of the regulatory framework of the profession of optician-lunetier. As such, ACUITIS has a team of qualified Quebec opticians. ARTICLE 2 – GENERAL

These general conditions define the conditions of use of the Sites and the conditions of purchase of products and services by an Internet user on them. Any creation of an account and/or order on the Site constitutes express and unreserved acceptance of these general conditions, without however this acceptance being conditioned by a handwritten signature on the part of the Customer. When ordering, the Customer declares to have read these general conditions and accepted the rights and obligations relating thereto.

ARTICLE 3 – QUALITY CONTROL

We check that our glasses fitted with corrective lenses and our sunglasses comply with CE standards.

ARTICLE 4 – CONFORMITY OF PRODUCTS AND SERVICES, UNAVAILABILITY

ACUITIS will make its best efforts to ensure that the photographic representation of the products or services on the Site is as faithful as possible to the products or services themselves. However, the range of products presented online is limited. It is also possible that the Customer's perception of the photographic representation of the products or services does not correspond exactly to the product or service itself. The Customer has the possibility of going to one of the ACUITIS Maisons to try the products.

ARTICLE 5 – GUARANTEES

1 year frame warranty :

Acuitis will repair or replace your frame if it has a manufacturing defect, free of charge during the first year following the invoice date. In the event of accidental breakage, Acuitis will replace your frame or the broken part with a 50% deductible during the first two years following the invoice date.

1 year Ophthalmic lens warranty:

Acuitis will replace your ophthalmic lenses if they show a processing or manufacturing defect during the first year following the invoice date. In the event of accidental breakage or scratches, Acuitis will replace the lenses with a 50% deductible during the first year following the invoice date.

Fit Guarantee (90 days) :

During the 90 days following the invoice date, the "progressive" lenses in the list below can be exchanged if you experience any discomfort resulting from the adaptation to the prescription issued by our optometrists. In the event of a product change, no credit will be given for lenses of lower value. The customer will have to pay the difference for the purchase of glasses of higher value.

For "single vision" and "progressive" lenses not on this list Acuitis will replace lenses with a deductible of 50%

Fit Guarantee:

Acuitis will adjust and clean your glasses free of charge for as long as you own them.

Refund Policy:

At Acuitis, we will be committed to quality by ensuring that the products prescribed to correct your vision are specifically designed to meet your personal needs, within parameters that are unique. We are therefore unable to offer refunds once partial or full payment has been received.  

ARTICLE 6 – PERSONAL DATA

ACUITIS collects personal data relating to any person consulting or using the Sites, or to the recipient of an order. This collection of data is therefore carried out in particular:

  • When a person subscribes to the Site's newsletter,
  • When a person creates an account on the Site,
  • When a person contacts the Site's Customer Service,
  • When a person browses the Site.

The data collected is intended for the use of ACUITIS. They are necessary for the processing and management of orders and more generally for commercial relations between ACUITIS and any person consulting or using the site.

By registering on the Site, a person can be informed of ACUITIS offers, in the form of newsletters, event emails or emails of personalized offers of products and services provided by ACUITIS. If a registered person no longer wishes to receive these offers, they can inform ACUITIS at any time by post or e-mail (contact details indicated in the "Contact" section of the Sites) or via the unsubscribe link contained in each of the emails sent. by ACUITIS to the email address provided during registration.

The Customer accepts the retention for 5 years of his personal visual correction data. These will under no circumstances be transferred or disclosed to third parties, except in the form of aggregated and non-personal statistics.

ARTICLE 7 – DATA RELATING TO SITE ATTENDANCE

Certain technical information may be collected when the Customer browses the Sites, such as the version of the Customer's browser (Chrome, Firefox, Safari, Opera, Internet Explorer, Edge, etc.), the type of operating system used ( Linux, Windows 10, Mac Os, etc.) and the IP (Internet Protocol) address of the computer used, in order to adapt the presentation and ergonomics of the Sites to the technical specificities of the Customer's terminal.

A cookie is a file that ACUITIS may save on the hard drive of the Customer's terminal via its Internet browser when the Customer uses the Sites, subject to its agreement or unless it opposes it. Only the issuer of a cookie is likely to read or modify the information contained therein.

ACUITIS uses cookies, intended to store information identifying Customers during the consultation of the Site in order to facilitate the browsing experience on the latter, subject to the choices that the Customer has expressed concerning cookies and which he may modify at any time. moment. In particular, the Customer has the possibility of opposing the recording of these cookies by modifying the options of his Internet browsing software. The cookies issued on the Site allow:

The cookies issued on the Sites are session cookies (whose duration is limited to the time of a connection to the Sites) and persistent cookies (whose duration, however limited, is greater than the duration of a connection).

Session cookies are only active during the Customer's visit and are deleted when he/she closes his/her browser. Persistent cookies remain stored on the hard drive of the Customer's terminal once his browser is closed, until he/she or his browser software purges them after a certain period or at any time.

When a Customer browses the Sites, cookies from third-party companies may be placed on the latter's computer, unless he has objected by configuring the parameters of his navigation software under the conditions described in the paragraph above. -below. ACUITIS notably uses technical cookies necessary for the proper functioning of the Sites. If the Customer refuses the registration of cookies in his terminal, or if he/she deletes those which are registered there, the Customer will no longer be able to benefit from a certain number of functionalities which are nevertheless necessary to navigate in certain areas of the Sites. . Where applicable, ACUITIS declines all responsibility for the consequences linked to the degraded operation of the Sites resulting from the impossibility for ACUITIS to record or consult the cookies necessary for their operation and which the Customer would have refused or deleted.

ARTICLE 8 – APPLICABLE LAW – DISPUTE

These General Conditions of Use in French will be executed and interpreted in accordance with Canadian law.

In the event of a dispute, the Customer shall first contact ACUITIS to obtain an amicable solution. In accordance with Article L 133-4 of the Consumer Code, in the event of a dispute, the consumer may resort to a conventional mediation procedure or any other alternative method of dispute resolution.

The search for an amicable solution does not interrupt the duration of the contractual guarantee or the deadlines for acting as guarantee.

Otherwise, the French courts will have sole jurisdiction.
