ACUITIS is the publisher and operator of the websites www.acuitis.com, www.acuitis.lu, www.acuitisuk.com, acuitis.ca and www.acuitis.ch (hereinafter referred to as the “Site” or “Sites”), whose purpose is the sale or presentation of optical products. This activity is carried out in strict compliance with the regulatory framework of the optician-monitoring profession. As such, ACUITIS has a team of qualified opticians registered with the Ordre des Opticiens du Québec. This team can be reached at nicolas.peumery@acuitis.com from 10am to 6pm, Monday to Friday. ACUITIS also has a network of Maisons in France, Luxembourg, Switzerland, England, Italy, Spain and Belgium.

ARTICLE 2 – GENERAL TERMS AND CONDITIONS

The present general terms and conditions define the conditions of use of the Sites and the conditions of purchase of products and services by an Internet user on the Sites. By creating an account and/or placing an order on the Site, the Customer expressly and unreservedly accepts these terms and conditions, without this acceptance being conditional upon a handwritten signature. By placing an order, the Customer declares that he/she has read the present terms and conditions and accepts the related rights and obligations.

ARTICLE 3 – QUALITY CONTROL

We check that our prescription glasses and sunglasses comply with CE standards.

ARTICLE 4 – CONFORMITY OF PRODUCTS AND SERVICES, UNAVAILABILITY

ACUITIS will make its best efforts to ensure that the photographic representation of the products or services on the Site is as faithful as possible to the products or services themselves. However, the range of products presented online is limited. It is also possible that the Customer's perception of the photographic representation of the products or services does not correspond exactly to the product or service itself. The Customer may visit one of the ACUITIS Maisons to try out the products.

ARTICLE 5 – GUARANTEES

2-year frame warranty

Acuitis will repair or replace your frame if it has a manufacturing defect, free of charge for the first two years following the invoice date. In the event of accidental breakage, Acuitis will replace your frame or the broken part free of charge the first time if the Tranquillité OR guarantee has been taken out, and with a 50% deductible for the second time during the first two years following the invoice date.

2-year Ophthalmic Lens Warranty:

Acuitis will replace your ophthalmic lenses if they have a treatment or manufacturing defect during the first two years following the invoice date. In the event of accidental breakage or scratches, Acuitis will replace broken lenses free of charge the first time if Tranquillité OR coverage has been taken out, and with a 50% deductible for the second time during the first two years following the billing date.

Adaptation guarantee (90 days) :

During the 90 days following the billing date, the << progressive >> lenses in the list below can be exchanged if you experience discomfort resulting from adaptation to the prescription issued by our optometrists. In the event of a product change, no credit will be given for lenses of a lower value. The customer will have to pay the difference for the purchase of higher-value lenses.

Refund policy:

At Acuitis, we are committed to quality by ensuring that the products prescribed to correct your vision are specifically designed to meet your personal needs, within your unique parameters. We are therefore unable to offer refunds once full or partial payment has been received.

ARTICLE 6 – PERSONAL DATA

ACUITIS collects personal data relating to any person consulting or using the Sites, or to the recipient of an order. This data is collected in particular:

  • When a person subscribes to the Site newsletter,
  • When a person creates an account on the Site,
  • When a person contacts the Site's Customer Service department,
  • When a person browses the Site.

The data collected is intended for use by ACUITIS. It is necessary for the processing and management of orders and more generally for commercial relations between ACUITIS and any person consulting or using the Site.

By registering on the Site, a person may be informed of offers from ACUITIS, in the form of newsletters, event emails or emails of personalized offers of products and services provided by ACUITIS. If a subscriber no longer wishes to receive these offers, he or she may inform ACUITIS at any time by mail or e-mail (contact information is provided in the “Contact” section of the Sites) or via the unsubscribe link contained in each e-mail sent by ACUITIS to the e-mail address provided at registration.

ACUITIS is responsible for processing this data. It may be transmitted to companies and subcontractors used by ACUITIS in the context of the services it offers or under the conditions indicated at the time of data collection on the Sites.

The processing of personal data implemented by ACUITIS via the Sites has been notified to the CNIL (www.cnil.fr) under N° 1905125.

In accordance with the French Data Protection Act of January 6, 1978, as amended, you have the right to access, rectify, modify and delete any data concerning you. To exercise this right, please write to serviceclient@acuitis.com (the e-mail must include the following subject line: I wish to modify/terminate my account): I wish to modify/terminate my ACUITIS account, using the contact form on the Site).
ACUITIS does not sell, market, or rent to entities outside the group to which it belongs any personal data concerning its customers.

The Customer accepts that his personal vision correction data will be kept for a period of 5 years. This data will under no circumstances be transferred or disclosed to third parties, except in the form of aggregated, non-personal statistics.


ARTICLE 7 – SITE TRAFFIC DATA

Certain technical information may be collected during the Customer's browsing of the Sites, such as the Customer's browser version (Chrome, Firefox, Safari, Opera, Internet Explorer, Edge, etc.), the type of operating system used (Linux, Windows 10, Mac Os, etc.) and the IP (Internet Protocol) address of the computer used, in order to adapt the presentation and ergonomics of the Sites to the technical specificities of the Customer's terminal.

A cookie is a file that ACUITIS may record on the hard disk of the Client's terminal through the Client's Internet browser when the Client uses the Sites, subject to the Client's consent or unless the Client objects. Only the sender of a cookie may read or modify the information contained therein.
ACUITIS uses cookies, designed to store information identifying Clients during consultation of the Site in order to facilitate the browsing experience on the Site, subject to the choices expressed by the Client concerning cookies, which may be modified at any time. In particular, the Customer may refuse to accept cookies by modifying the options of his/her Internet browser. On this point, see the advice on how to modify these options depending on the browser used, accessible on the page of the website of the Commission Nationale de l'Informatique et des Libertés: www.cnil.fr.

Cookies on the Site are used to

Adapt the presentation of the Sites to the display preferences of the customer's terminal (language used, display resolution, operating system used, etc.) when using the Sites, depending on the hardware and software used for viewing or reading the terminal,
To establish statistics and measures of frequentation and use of the various elements making up the Sites (sections and content visited, routes, etc.), enabling ACUITIS to improve the interest and ergonomics of the Site,
To memorize information relating to a form that the Client has filled in when using the Site (registration or access to his/her account),
The cookies issued on the Sites are session cookies (whose duration is limited to the time of a connection to the Sites) and persistent cookies (whose duration, however limited, is longer than the duration of a connection).

Session cookies are active only for the duration of the customer's visit, and are deleted when he/she closes the browser. Persistent cookies remain stored on the hard disk of the Customer's terminal once the browser has been closed, until he/she or his/her browser software purges them after a certain period or at any time.

When a customer browses the Sites, cookies from third-party companies may be placed on the customer's computer, unless the customer has objected by configuring his/her browser settings as described in the paragraph below. The purpose of these cookies is to identify the products consulted on the Sites and to collect browsing data in order to personalize the advertising offer that may be presented to the customer outside the Sites. In the context of this type of advertising partnership, each Site may transmit to the partner anonymous browsing data concerning the products consulted by the customer while browsing the Sites.
The customer has several options for managing cookies. Any settings the customer may make may affect their Internet browsing and their access to certain services requiring the use of cookies.

Customers can configure their browser software so that cookies are stored in their terminal or, on the contrary, rejected, either systematically or depending on the sender. The Client may also configure his browser software so that acceptance or rejection of cookies is proposed from time to time, before a cookie is likely to be saved on his terminal.

In particular, ACUITIS uses technical cookies necessary for the proper functioning of the Sites. If the Client refuses to accept cookies on his/her terminal, or if he/she deletes the cookies stored on his/her terminal, the Client will no longer be able to benefit from a certain number of functionalities which are nevertheless necessary to navigate in certain areas of the Sites. Where applicable, ACUITIS declines all responsibility for the consequences linked to the degraded operation of the Sites resulting from the impossibility for ACUITIS to record or consult the cookies necessary for their operation and which the Client has refused or deleted.

ARTICLE 8 – APPLICABLE LAW – DISPUTE

These General Terms and Conditions of Use in the French language will be executed and interpreted in accordance with Canadian law.

In the event of a dispute, the Client will first contact ACUITIS to obtain an amicable solution. In accordance with article L 133-4 of the French Consumer Code, in the event of a dispute, the consumer may have recourse to a conventional mediation procedure or any other alternative dispute resolution method.

The search for an amicable solution does not interrupt the duration of the contractual warranty or the time limits for taking legal action.

Failing this, the French courts shall have sole jurisdiction.
